A football move can look like one event from the outside, but legally it may involve several different relationships. Treating them as one deal can blur who owes what, who represents whom and which money belongs to the player, the clubs or another party.
The club to club agreement
When a contracted player moves between clubs, the transfer or release agreement deals with the clubs’ commercial terms, registration cooperation and any clearly defined future club to club economics. It should not become an employment contract for the player or a representation agreement for an agent.
The player employment contract
The employment contract is between the player and the employing club. It should deal with the term, fixed remuneration, bonuses, benefits, duties, medical and welfare arrangements, image or commercial rights where relevant, renewal or termination rules and any lawful player participation in transfer compensation.
The football agent agreement
Regulated football agent services require their own compliant representation relationship with the appropriate licensed person. The client, services, fee, duration and signatures should be clear. An academy, foundation, scout or commercial partner should not be paid an agent style success fee simply by giving another payment a different label.
NEXTGEN support is separate again
A NEXTGEN Foundation support or Give Back arrangement does not replace the player’s employment contract, the club to club transfer agreement or a football agent representation agreement. It does not give NEXTGEN ownership of the player, the player’s registration or a future transfer receivable.
Why separation protects the player
- The player can see exactly which document controls salary and employment rights.
- Clubs can see which agreement governs transfer or release economics.
- Agent services and fees are identifiable rather than hidden inside another payment.
- Foundation support cannot be used to buy selection, representation or transfer control.
- Disputes are less likely to become leverage over an unrelated part of the player’s career.
Before signing, players and families should ask for complete copies of the documents that affect them and obtain independent advice where the terms are important or unfamiliar. The rules and mandatory law that apply to the actual transaction always prevail.
